Welcome to our website. These Terms and Conditions (“Terms”) govern your access to and use of our website, as well as the transportation, freight, and dispatching services provided by our company (“Carrier,” “we,” “us,” or “our”). By requesting a quote, booking a shipment, or using our services, you (“Shipper,” “Customer,” or “you”) agree to be bound by these Terms.

1. Services Provided

We operate as a licensed motor carrier providing general freight transport, temperature-controlled (reefer) shipping, hot shot services, last-mile and white-glove delivery, and freight dispatching services. All shipments are subject to equipment availability and our acceptance of the load.

2. Shipper Responsibilities

  • Accuracy of Information: The Shipper is responsible for providing accurate and complete information regarding the shipment, including weight, dimensions, commodity type, value, and specific pickup/delivery instructions. We reserve the right to adjust rates if the actual shipment differs from the provided details.
  • Packaging and Loading: Unless utilizing our white-glove services, the Shipper is responsible for ensuring that all goods are properly packaged, secured, and ready for transport to withstand the normal rigors of transit.
  • Alcohol and Regulated Commodities: We actively partner with local alcohol distributors. The Shipper warrants that they hold all necessary licenses and permits required for the sale, shipment, and distribution of alcohol or any other regulated commodities. We are responsible only for the transport of these goods in accordance with applicable state and federal laws.

3. Rates, Charges, and Payment

  • Quotes: Freight quotes are based on the information provided at the time of the request and are subject to change if the shipment details (weight, dimensions, routing, or fuel surcharges) change.
  • Accessorial Charges: Additional charges may apply for services outside the standard transport agreement, including but not limited to detention, layover, lumper fees, inside delivery, or unforeseen route diversions.
  • Payment Terms: Unless a prior credit agreement has been established, payment is due upon receipt of the invoice. We reserve the right to withhold delivery or hold a lien on cargo for unpaid freight charges.

4. Freight Liability and Claims

  • Liability Limits: Our liability for loss, damage, or delay of freight is governed by federal law (the Carmack Amendment) and is limited to the terms outlined in our standard Bill of Lading (BOL), unless a higher declared value is explicitly agreed upon in writing prior to transit and applicable premiums are paid.
  • Filing Claims: Any claims for loss, damage, or shortage must be noted on the delivery receipt at the time of delivery. Formal claims must be filed in writing within nine (9) months of the delivery date (or the expected delivery date in the event of loss).
  • Consequential Damages: We are not liable for any indirect, incidental, special, or consequential damages, including loss of profits, arising from delayed delivery or damaged freight.

5. Prohibited Cargo

Unless explicitly agreed upon in writing and permitted by our operating authority, we do not transport:

  • Illegal contraband or stolen property.
  • Hazardous materials (Hazmat) requiring placards, unless specifically contracted.
  • Live animals.
  • Unpackaged or improperly secured freight that poses a safety risk.

6. Independent Contractor Status

When providing dispatching services, we act as an independent contractor on behalf of the client. We do not assume liability for the actions, negligence, or omissions of third-party carriers or brokers booked through our dispatching services.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, as well as applicable federal transportation laws. Any legal disputes arising from these terms or our services shall be resolved in the appropriate state or federal courts located in Kentucky.

8. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this page with an updated Effective Date. Continued use of our website or services constitutes acceptance of the revised Terms.
